Implementing SPLUMA: A Review of Municipal Planning By-Laws

The Spatial Planning and Land Use Management Act 16 of 2013 places municipalities at the heart of the regulation of land use. It instructs municipalities to appoint Municipal Planning Tribunals, ensure wall-to-wall zoning and decide land use applications. Municipal planning by-laws are now emerging as a critical layer of planning law. This report examines 15 'first generation' planning by-laws and assesses how these by-laws deal with issues such spatial development frameworks, reducing red tape, dealing with informality and connecting with other layers of law.
