Enforcing Socio-economic Rights: The Role of the Courts

Judge Arthur Chaskalson gave a summary of the various socio-economic rights-related cases that had been heard before the Constitutional Courts whilst he was Chief Justice of South Africa. He highlighted the tensions that existed with individual cases, such as the Grootboom, Soobramoney and the Treatment Action Campaign cases. He spoke about the obligation of the state, the justiciability of socio-economic rights and the rights enshrined in the Constitution.
