Constitutionnalisme et démocratie sous l’empire de la constitution du 18 février 2006 en République Démocratique du Congo : entre espoirs et déceptions (Constitutionalism and democracy under the constitution of 18 February 2006 in the Democratic Republic of Congo: between hope and disappointment)

The DRC adopted a new Constitution in 2006, which promotes democratic values, constitutionalism and the rule of law. Constitution served as a basis to organise elections in 2006 and 2011; the outcome of the latter were criticised. Seven years after the adoption of the new constitution, questions arise as to the willingness of politicians to create a political and legal system respectful of the new constitutional values. The paper will examine whether the values of the constitution have been effectively implemented and translated into changes in practice.

Noël KABEYA est Assistant à la Faculté de Droit de l’Université de Kinshasa (UNIKIN) et Chef des Travaux à la Faculté de Droit de l’Université Libre de Kinshasa (ULK). Avocat au Barreau de Kinshasa/Gombe, il a été représentant de la Faculté vainqueur du 16ème Concours Africain de procès fictif des droits de l’homme (Août 2007). Il a participé à plusieurs conférences et formations en droits de l’homme, Droit International Humanitaire et Droit Pénal International en Ethiopie (2006), en France (2008), aux Pays-Bas (2009 et 2010) ainsi qu’en Autriche (2011) Outre ses activités scientifiques, il travaillé pour des ONG Internationales des droits de l’homme et d’appui au secteur de la justice en République Démocratique du Congo. Depuis janvier 2010, il exerce les fonctions de Directeur Exécutif de l’Institut Congolais des Droits de l’Homme (ICDH).
